Protected Class Sexual Harassment
The U.S. Equal Employment Opportunity Commission (EEOC) classifies harassment as a form of employment discrimination. The law seeks to protect specific classes from discrimination. Protected classes include a person's race, color, religion, sex (including pregnancy, gender identity, and sexual orientation), national origin, age (40 or older), disability or genetic information. It may violate Title VII of the Civil Rights Act of 1964, Age Discrimination in Employment Act of 1967, or Americans with Disabilities Act of 1990. Under Florida law, harassment may violate the Florida Civil Rights Act. A primary element of many sexual harassment claims concerns proof that you are a member of at least one protected class and that the bad behavior related directly to the protected class status. Furthermore, you must also be able to prove, in most cases, that the employer knew about he problem, but did nothing about it. Therefore, most of the time you must report the bad behavior immediately to your supervisor or Human Relations department.
